Expert Witness Reports

Valkyrie prepares independent, CPR Part 35 compliant expert reports on digital evidence for litigation and arbitration. Our experts are Bond Solon trained in expert witness duties, and our reports are written for judges, arbitrators and lawyers rather than technical specialists.

What our reports cover

  • The instructions received and the questions we were asked to answer
  • The material examined and how it was preserved
  • The methodology and tools used, so another expert can test our work
  • Our findings, the range of reasonable opinion and any limitations
  • A statement of truth and a declaration of the expert’s duties to the court

Party-appointed or single joint expert

We can be instructed by one party or jointly. Either way, our duty is to help the court or tribunal on matters within our expertise, and that duty overrides any obligation to the party paying our fees.

Reviewing the other side’s evidence

We review and comment on opposing expert reports, prepare written questions, attend experts’ meetings and contribute to joint statements that narrow the issues in dispute.

Giving evidence

Where a matter proceeds to a hearing, we give oral evidence and explain technical findings clearly under cross-examination.

When should we instruct an expert?

As early as possible. Devices get reused, accounts get closed and logs expire. Early preservation protects evidence that may otherwise be lost before disclosure.

Can you work within arbitration rules?

Yes. We prepare expert evidence for arbitral tribunals as well as the courts, adapting format and timetable to the procedural rules agreed.
